On March 12, 2009 the California Assembly approved House Assembly Bill 5, which seeks to amend the California Code of Civil Practice to include rules governing the discovery of electronically stored information. The California Act is modeled closely after the Federal Rules of Civil Procedure, and tracks the language of the Federal Rules on issues related to production format, the scope of e-discovery, and cost shifting.
