Effective January 1, 2022, Louisiana Rules of Professional Conduct 7.2, 7.4, 7.5, 7.6, 7.7 and 7.8 will be amended to:

  • Require that Lawyer Advertisements display a Filing Number issued by the LSBA. Any lawyer named in the ad must certify that the ad was filed and assigned such a number, and any ad or other unsolicited written communications, (except those subject to the exemptions stated in Rule 7.8), must include the Filing Number.

 

  • Require that any communication referencing past results to include a disclaimer such as “Results May Vary” or “Past Results are Not a Guarantee of Future Successes.”

 

  • Prohibit the use of any non-lawyer spokesperson in an advertisement, even with a disclaimer.

 

  • Clarify that “computer-accessed communications” includes information regarding a lawyer’s or a law firm’s services that is read, viewed, or heard directly through the use of a computer – namely, Internet Home Pages or World Wide Websites and unsolicited E-Mail communications.
